PRIVACY POLICY OF THE TIGRITO PRO PLATFORM

1. GENERAL PROVISIONS AND IDENTIFICATION OF THE CONTROLLER

This Privacy Policy (hereinafter, the “Policy”) is intended to comprehensively regulate the collection, use, storage, processing, protection, retention, transfer and all other operations applicable to the personal data of natural or legal persons who access, register for or use the digital platform known as TigritoPro, including its mobile application, website, technological interfaces, digital tools, associated systems and any current or future functionality (hereinafter, the “Platform”).

The Platform is operated by Garcia’s Technology Firm C.A., a commercial company duly incorporated under the laws of the Bolivarian Republic of Venezuela, acting as the controller of the processing of personal data (hereinafter, “TigritoPro”, the “Company” or the “Controller”).

Access, registration or use of the Platform implies the express, free, informed, unequivocal and voluntary acceptance of this Policy, as well as the processing of personal data under the terms established herein.

By using the Platform, the User declares that:

  • They have read, understood and fully accepted the content of this Policy;
  • They expressly, previously, knowingly and unequivocally authorize the processing of their personal data;
  • They acknowledge that providing information is a necessary requirement for the proper provision of the services offered by the Platform;
  • They guarantee that the data provided is truthful, complete, accurate and up to date.

The User assumes full responsibility for any inaccuracy, omission, falsehood or outdated information provided.

TigritoPro reserves the right to suspend, limit or cancel access to the Platform when it detects inconsistencies, irregularities or breaches related to the information provided.

3. CATEGORIES OF PERSONAL DATA SUBJECT TO PROCESSING

TigritoPro may collect, record, store, organize, structure and process various categories of personal data, including, but not limited to:

3.1 Identification and Contact Data

Data necessary for the creation, validation and management of the User’s account, such as full name, telephone number, email address, profile information, identification documents and any other data required for the proper identification of the User within the Platform.

3.2 Operational, Transactional and Interaction Data

Information related to the use of the Platform, including service history, requests, bookings, payments, interactions between Users, browsing behavior, preferences, activity records, dates, times and duration of sessions.

3.3 Geolocation Data

Information relating to the User’s geographic location, whether precise or approximate, obtained through technologies such as GPS, IP address or other technological mechanisms, always with the User’s prior authorization when applicable.

3.4 Financial and Payment Data

Information linked to transactions, payment methods, financial identifiers and economic operations carried out within the Platform, processed directly or through authorized external providers. TigritoPro does not store complete sensitive bank card information when such management is handled by specialized third parties.

3.5 User-Generated Content

Includes messages, reviews, ratings, images, documents, files and any other information or content that the User provides, publishes or generates within the Platform.

3.6 Technical, Analytical and Security Data

System records (logs), IP addresses, device information, operating system, browser, technical identifiers and data used for the detection of suspicious activities, fraud prevention and protection of the integrity of the Platform.

3.7 Biometric Data and Identity Verification

TigritoPro may request and process biometric data from certain Users, especially Service Provider Users, when necessary for identity validation processes, fraud prevention, operational security and strengthening trust within the Platform.

This data may include facial images, selfie-style photographs, real-time face validations, facial biometric comparison and any other reasonable identity verification mechanism implemented by the Platform.

For such processes, TigritoPro may use specialized third-party technological services, including Amazon Rekognition from Amazon Web Services (AWS), or any other equivalent biometric verification tool that performs similar functions.

The exclusive purpose of this processing shall be to:

  • Validate the real identity of the User;
  • Prevent identity theft or impersonation;
  • Detect fraud attempts or fraudulent registrations;
  • Strengthen the operational security of the Platform;
  • Comply with legal, operational and risk prevention obligations.

Biometric data shall be considered sensitive data and shall receive an enhanced level of protection in accordance with reasonable technical, organizational and administrative security standards.

TigritoPro shall not market, sell or use biometric data for purposes other than those expressly established herein.

Biometric data shall be retained only for the time strictly necessary to fulfill the purpose of identity verification, fraud prevention, legal obligations, dispute resolution or security audits, and may be kept even after account termination when there is legal, contractual or operational security justification.

Once such purpose has been fulfilled and when legally appropriate, the data may be blocked, anonymized or deleted in accordance with TigritoPro’s internal information retention protocols.

The User expressly acknowledges and authorizes this biometric processing as a necessary condition for the use of certain Platform functionalities, especially those related to the provision of professional services and trust validation between Users.

4. PURPOSE OF PERSONAL DATA PROCESSING

Personal data shall be processed for legitimate, specific and proportionate purposes, including, among others:

  • The creation, administration and management of User accounts;
  • The facilitation of connections between Client Users and Service Providers;
  • The execution, management and monitoring of services requested through the Platform;
  • The processing of payments, validations and financial operations;
  • The continuous improvement of the Platform through behavior, trend and usage analysis;
  • The implementation of security, fraud prevention and identity validation mechanisms;
  • The sending of operational, informational or promotional communications;
  • Compliance with legal, regulatory obligations or requests from competent authorities.

5. DATA PROCESSING OPERATIONS

The User expressly authorizes TigritoPro to carry out, directly or through third parties, all operations necessary for the processing of their personal data, including:

  • Collection, recording, organization and storage;
  • Modification, updating and consultation;
  • Use, analysis and segmentation;
  • Transfer and communication;
  • Interconnection of databases;
  • Blocking, suppression or deletion.

Such operations may be carried out through automated processes, artificial intelligence systems, analytical algorithms, technological tools or human intervention when necessary.

6. GEOLOCATION AND SERVICE ADDRESSES

TigritoPro may use geolocation technological tools in order to optimize the provision of services, validate their execution and improve the User experience.

Location information and service addresses shall be shared exclusively with the Users involved in the provision of the service and may be used as evidence in verification, control or dispute resolution processes.

7. SHARING AND TRANSFER OF PERSONAL DATA

Personal data may be shared, transferred or communicated to:

  • Service Provider Users, to the extent necessary for the execution of services;
  • Technological and operational providers, such as hosting services, payment processing, data analysis or technical support;
  • Competent authorities, in compliance with legal obligations;
  • Entities affiliated, linked or related to TigritoPro.

Likewise, data may be transferred in the context of corporate operations, such as mergers, acquisitions, reorganizations or business restructurings.

8. DERIVED DATA, ANALYTICS AND COMMERCIAL USE

TigritoPro may generate derived information from personal data, including statistics, behavioral patterns, predictive analyses, metrics and market studies.

Such information may be used for commercial, strategic, operational or service improvement purposes, provided that it does not directly identify the User when anonymization is legally applicable.

9. USE OF COOKIES AND TRACKING TECHNOLOGIES

The Platform may use cookies, web beacons, server logs, tracking technologies and retargeting tools in order to improve the User experience, analyze usage behavior and personalize content or advertising.

The User may manage or restrict the use of such technologies from their device or browser settings, understanding that some functionalities may be limited.

10. RETENTION OF PERSONAL DATA

Personal data shall be retained for the time necessary to fulfill the purposes described in this Policy.

TigritoPro may retain the information for additional periods when necessary to:

  • Comply with legal obligations;
  • Address judicial or administrative proceedings;
  • Prevent fraud;
  • Manage debts, disputes or claims;
  • Maintain security audits and internal control.

11. INFORMATION SECURITY

TigritoPro implements reasonable technical, organizational, administrative and technological measures aimed at protecting Users’ personal data against unauthorized access, loss, alteration, improper disclosure, accidental destruction, fraudulent use or any unauthorized processing.

The main infrastructure of the Platform may be hosted and supported by Amazon Web Services (AWS), an international cloud infrastructure provider recognized for its high standards of security, availability, operational redundancy and information protection.

Likewise, TigritoPro may use complementary technological services for security, performance, perimeter protection and operational management, including specialized providers such as Cloudflare, Hostinger or other equivalent services that help strengthen the stability, availability, monitoring, attack mitigation, protection against malicious access, traffic control and operational continuity of the Platform.

The protection measures implemented may include, among others:

  • Enhanced authentication systems;
  • Restricted access controls;
  • Biometric and identity validations;
  • Encryption of information when applicable;
  • Monitoring of suspicious activity;
  • Fraud and identity theft prevention;
  • Backups and recovery mechanisms;
  • Protection against automated attacks, malicious access and infrastructure vulnerabilities;
  • Auditing, traceability and internal control tools.

Nevertheless, the User expressly acknowledges that no computer system, technological infrastructure, cloud service or security mechanism can guarantee absolute protection or total invulnerability against external incidents, third-party attacks, force majeure events, unforeseeable technical failures or fraudulent conduct beyond TigritoPro’s reasonable control.

Accordingly, TigritoPro shall act under criteria of reasonable diligence and available operational best practices, without assuming an absolute obligation of result regarding the total impossibility of security incidents.

12. USER RIGHTS

The User may exercise the rights of access, rectification, updating, deletion or revocation of consent with respect to their personal data, in accordance with applicable regulations.

The exercise of such rights may be subject to legal, contractual, operational or mandatory information retention limitations.

13. LIMITATION OF LIABILITY

The User acknowledges that the processing of personal data is carried out at their own risk within the reasonable protection limits offered by the Platform.

TigritoPro shall not be liable for:

  • Unauthorized access arising from external causes;
  • Failures of third-party providers;
  • Misuse of information by the User;
  • Force majeure events or circumstances beyond its reasonable control.

14. COMMUNICATIONS

The User authorizes TigritoPro to contact them through any registered means, including email, in-Platform notifications, digital messaging or any other channel reasonably linked to the operation of the service.

15. APPLICABLE LAW

This Policy shall be governed by and interpreted in accordance with the laws of the Bolivarian Republic of Venezuela.

16. MODIFICATIONS TO THE POLICY

TigritoPro may modify, update or replace this Privacy Policy at any time when necessary for legal, operational, technological, commercial, regulatory or Platform improvement reasons.

When such modifications are relevant or substantially affect the processing of Users’ personal data, TigritoPro shall notify registered Users by email and/or through notices within the Platform.

Continued use of the Platform after such notification shall imply express acceptance of the modifications made and of the updated processing of personal data in accordance with the new version of this Policy.

If the User does not agree with the new personal data processing conditions, the User must refrain from continuing to use the Platform and may request, when legally applicable, the deletion of their account or the revocation of certain consents in accordance with applicable regulations.

TigritoPro recommends that Users periodically review this Policy to remain informed about how their personal information is protected and processed.
